SNOWPASS is committed to protecting and respecting your privacy and we make it our highest priority to safeguard the confidentiality of any and all personal information you provide to us.

This policy, together with our Terms of Service and Cookie Policy, sets out the approach that we, SNOWPASS, take to the collection and handling of any such information and applies to all websites, mobile apps and other services operated by us such as newsletters and price alerts (the “SNOWPASS Services”).

By using the SNOWPASS Services you are deemed to agree to our use of your information in accordance with this policy. We encourage you take a few minutes to read through it and contact us if you have any queries.

What kind of information does SNOWPASS collect?

Most information that we collect from you is linked to non-personal identifiers such as anonymous User IDs or device IDs and does not enable you to be identified as an individual in the offline world (“Non-Personal Information”). Such Non-Personal Information includes things like your browser type, the type of device you are using, access times, the website you arrived at SNOWPASS from, the features or functionality you selected whilst using the SNOWPASS Services and your general geographic location.

Where necessary, we will also collect information from you that does enable you to be identified as an individual in the offline world, such as your name, email address, or payment details (“Personal Information”). In order to minimise the impact on your privacy, we will never knowingly collect more Personal Data than is strictly necessary to perform the activities described in this policy.

How and when does SNOWPASS collect this information?

We collect information that you voluntarily provide to us during your use of the SNOWPASS Services. This can range from Non-Personal Information, such as the dates and desired destination, to the Personal Information you are required to submit when you wish to buy a SNOWPASS CARD via the SNOWPASS Services. Whether or not you provide us with this kind of information is always entirely under your control. Although, in the case of not providing the necessary personal data, the purchase and use of a SNOWPASS CARD cannot become effective.

In addition to information that you voluntarily provide to us, we also collect certain Non-Personal Information directly from you as you use the SNOWPASS Services, as well as indirectly where it is provided to us automatically by a third party application, social media site (such as Facebook or Twitter) or other website (such as a promotion partner) that you connect to the SNOWPASS Services from.

How does SNOWPASS use this information?

To deliver the SNOWPASS Services

We use your information to deliver the SNOWPASS Services and the specific features and functionality you request. This includes things like generating the search results that most accurately match your search criteria, storing your Personal Information to enable you to pre-fill future booking forms, facilitating the completion of any bookings with a third party supplier via the SNOWPASS Services, assisting you with post-booking issues, or emailing you newsletters or price alerts that you have selected to receive.

To optimise & personalise the SNOWPASS Services

In addition to using your information to deliver the essential aspects of the SNOWPASS Services, we also use it to optimise and personalise your experience of the SNOWPASS Services. For instance, we will use cookies to remember your language and currency preferences and may also personalise your experience by highlighting or recommending certain information or ski resort options that we believe is relevant to you based on your search history and use of the SNOWPASS Services.

To deliver appropriate advertising

We use Non-Personal Information, such as what you have searched for on the SNOWPASS Services or your general geographic location, to present you with relevant advertisements. For instance, we may use third party advertisement retargeting services to send you an advertisement related to destination you have searched for.

To better understand, improve and protect the SNOWPASS Services

We use information we collect about how users interact with the SNOWPASS Services in order to identify and correct faults, improve our services and inform business decisions, as well as for security and fraud-prevention purposes.

To generate aggregated datasets that inform our business and ski resort partners

We use information we collect about users to generate datasets of Non-Personal Information. These datasets allow us to generate helpful product insights. For instance, we can monitor demand for destinations to make sure the ski resort options our users want are available on the SNOWPASS Services.

To contact you

We use your information to contact you with confirmations, notifications or alerts you have requested, such as email newsletters or price alerts, or which are otherwise necessary for us to send to you in order to provide the SNOWPASS Services you have selected, such as details of any purchases you have made on the SNOWPASS platform. We may also notify you about any changes or updates to the SNOWPASS Services or to respond to communications you have sent us, such as via our customer service help centre or on social media.

Do any third parties collect information about me when I use the SNOWPASS Services?

Yes, when you make a booking with a third-party provider from within the SNOWPASS platform, any information you submit as part of the booking process may be collected by that third party in order to process the booking. Your information will be used by those third parties in accordance with their own terms and conditions and privacy policy.

In addition, third party advertisement services may collect Non-Personal Information from you as you use the SNOWPASS Services via cookies and other similar technologies. This information enables you to be served with relevant advertisements, both on the SNOWPASS Services and on third party websites and applications around the web.

When will SNOWPASS share your information with third parties?

Sharing Personal Information with third parties who process it only under SNOWPASS’s instruction

We share information relating to our users with selected third parties who perform services on our behalf and under our instruction. We ensure that any Third Party Processor which handles information on our behalf does so pursuant to contractual terms which require that the information is kept secure and, when that information contains any Personal Information, is processed in accordance with applicable data protection laws and used only as we have instructed and not for that Third Party Processors’ own purposes (unless you have explicitly consented to them doing so).

Third Party Processors may be located, or process your information, outside of the country in which you are based. Where our use of a Third Party Processor involves the transfer of Personal Data from within Europe to a location outside of the European Economic Area, we will put in place appropriate measures to ensure that the Personal Data is adequately protected in that location, most often by applying European Commission-approved standard contractual clauses and robust security checks.

Sharing your information with third parties for processing outside SNOWPASS’s control

We will share your Personal Information with third parties for processing outside SNOWPASS’s control and for their own purposes in the following three scenarios: (1) when you purchase a SNOWPASS CARD on the SNOWPASS platform, we must share information (including Personal Information) with partner ski resorts you visit for their standard verification and fraud-detection purposes, or to a third party contracted to provide those services on the ski resort’s behalf; (2) your personal data provided by SNOWPASS to the partner ski resorts visited, may also be used by them to promote their own ski resort or associated services, namely, but not only, for promotional campaigns, classes, rental of equipment and accommodation (3) when we run a promotion in conjunction with a partner for the purpose of sending promotional information.

Non-Personal Information, such as fully anonymised datasets containing aggregated SNOWPASS Services’ usage information or trend-level travel insights, may be shared by us with third parties. As described above, third party advertising businesses may collect Non-Personal Information from you via cookies and other tracking tools whilst using the SNOWPASS Services.

Sharing your information with FIS (International Ski Federation)

FIS (International Ski Federation) integrates the network of SNOWPASS partners in the area of the partnership of the product SNOWPASS CARD, which promotes the development of the leisure practice of winter sports.

By using the SNOWPASS services you expressly acknowledge and agree that SNOWPASS shares your personal data with FIS, for processing outside SNOWPASS’s control and for their own purposes namely, but not limited to, sending promotional information and for direct marketing purposes.

You also understand and accept that some of the personal data shared with FIS may enable that you are identified as an individual in the offline world, such as first name, last name, email, date of birth, address and country.

Your personal data will be disclosed in accordance with the terms described in Recital 47 of the General Data Protection Regulation (EU) 2016/679 ("GDPR").

Disclosing information for legal and other reasons

We may disclose your information where necessary to enforce our Terms of Service or other agreements, or to a prospective buyer or ultimate buyer if SNOWPASS itself (or part of our business) is sold. We may also disclose your information if necessary, to prevent, detect or prosecute illegal or suspected illegal activities or to prevent other damage or in response to a legal action against us or to enforce our rights and claims.

How does SNOWPASS keep my Personal Information safe and secure?

We make the confidentiality and security of your Personal Information our highest priority and we limit access to it to only those SNOWPASS employees who need to come into contact with it in order to fulfil their role and enable the SNOWPASS Services to be provided to you.

Although we do our best to protect your Personal Information, the transmission of information via the Internet can never be completely secure and we are therefore unable to guarantee the security of the information which you share with us at your own risk.

Where does SNOWPASS store my information?

The information we collect from you is stored on secure servers in various locations around the world. However, any Personal Information we collect from you is only stored within servers located in either the USA or Europe. Regardless of location, we ensure that adequate technical and organisational measures are in place to protect the security of any information we store on our servers.

Does SNOWPASS use cookies or other tracking tools?

We use a combination of cookies and similar tracking technologies to collect, in line with this policy, Non-Personal Information from you relating to how you are using the SNOWPASS Services. Please see our Cookie Policy for more detailed information on how the SNOWPASS Services make use of these technologies.

As explained above, third party advertisers will also collect Non-Personal Information from you using cookies and similar technologies for the purposes of serving you relevant advertisements both on the SNOWPASS Services and on other third-party platforms as you move around the web, including on different devices. You may be able to control how these technologies are applied to you via the settings in your browser or on your mobile’s operating system.

Do third party platforms comply with this policy?

The SNOWPASS Services contain links to third party websites and applications and may sometimes give you the option to export information to those platforms. Please be aware that we are not responsible for the privacy practices of such third-party websites. When you leave or otherwise cease using the SNOWPASS Services or transfer your information from the SNOWPASS Services to a third-party platform, we encourage you to read the applicable privacy policies of each and every third-party platform that you allow to collect information from you.

SNOWPASS's advises about children

We encourage parents to monitor and supervise the on-line activities of their children and to consider using parental control tools available from on-line services and software manufacturers that help guarantee a child-friendly on-line environment. These tools help prevent children from disclosing their name, address, and other personal information without parental permission.

How can I access or manage my Personal Information?

Service Terms

Who are we?

SNOWPASS (“us” or “our”, depending on the context) is a global company that provides instant online ski resort search services (including but not limited to SNOWPASS CARD) to users worldwide through our websites, applications or other platforms (“SNOWPASS Platforms”). SNOWPASS is not a ski resort and is not responsible for the skiing facilities of the partner ski resorts. All these services are provided by third parties and are covered by the terms and conditions stipulated by these third parties. The SNOWPASS Services and the SNOWPASS Platforms are provided by SNOWPASS, LDA., a limited liability company incorporated and registered in Portugal with registration number 514 818 174. Company data, including mailing address and registered address and are available at www.snowpass.com.

Terms

These terms and conditions (“Terms”) govern your access to and use of the SNOWPASS Services and / or the SNOWPASS Platforms and, together with our Privacy Policy, constitute a legal agreement between you and SNOWPASS. By downloading, accessing or using the SNOWPASS Services and / or the SNOWPASS Platforms, we assume that you have read, understood and agreed to these Terms and the Privacy Policy. We may change these Terms at any time, at our discretion. If applicable, you will be requested to confirm your acceptance of these terms and conditions.

Some of the SNOWPASS Services and / or SNOWPASS Platforms (for example, our “SNOWPASS for Business” B2B products) provide different terms and conditions regarding the use of these services.

Using SNOWPASS Services

SNOWPASS Services and SNOWPASS Platforms may only be used in compliance with applicable laws and for legitimate purposes. With respect to your acceptance to comply with these Terms, we grant you a non-transferable and non-exclusive license to transfer, access and use the SNOWPASS Service and / or SNOWPASS Platforms exclusively for personal and non-commercial purposes. In particular, we grant this license if you agree not to:

  1. Use the SNOWPASS Services and / or SNOWPASS Platforms for any inappropriate, illegal purpose, or publish, share or transmit any (i) defamatory, offensive, obscene or objectionable material; (ii) infringes the confidentiality or privacy of any rights of third parties, including copyrights, trademarks or other intellectual property rights; (iii) which is published, shared or transmitted for the purpose of advertising or promoting yourself or a third party; or (iv) is misleading or false concerning your identity or suggests that you are sponsored by, affiliated with or connected to the SNOWPASS;
  2. Use the SNOWPASS Services and / or the SNOWPASS Platforms for any commercial purpose, or in any way that could prejudice or discredit the SNOWPASS;
  3. Disassemble, reverse engineer or decompile any software, application, upgrade or hardware existing or available through the SNOWPASS Services and / or Platforms, except as permitted by law;
  4. Copy, distribute, publicly communicate, sell, rent, lend or use the SNOWPASS Services and / or SNOWPASS Platforms, or attempt to breach or unblock any security measures used to prevent or limit your access to or use of the SNOWPASS Services SNOWPASS and / or SNOWPASS Platforms;
  5. Use or interfere with the SNOWPASS Services and / or SNOWPASS Platforms in a manner that may damage, disable, overburden, invalidate or compromise our systems or security, or interfere with other users;
  6. Submitting or transmitting through any of the SNOWPASS Services and / or SNOWPASS Platforms any malicious program code, virus, service blocking attack or spam, worm, Trojan horse, authorization key, license control utility or software lock;
  7. Remove, change or replace any proprietary notices, trademarks, trade names, logos or other designations of origin in the SNOWPASS Services and / or the SNOWPASS Platforms or attempt to pass the SNOWPASS Services and / or the SNOWPASS Platforms as a product of another entity other than SNOWPASS;
  8. Use any program or automatic application to scan, copy, index, sort or exploit SNOWPASS Services and / or SNOWPASS Platforms or any part thereof;

If you register for any feature or use of the SNOWPASS Services and / or the SNOWPASS Platforms that require the use of an access account and password, you agree that you are responsible for keeping your password and access data confidential and secure. If you are aware or suspect that the security of your access data has been compromised, please let us know as soon as possible;

If any element of the SNOWPASS Services and / or SNOWPASS Platforms is hosted on a third party website (for example, Facebook or any other social media website) and there are separate terms and conditions for the use of that third party web site, you agree to fully comply with these terms and conditions;

Sharing information with us

For us, privacy is a very serious matter and we always operate in accordance with applicable data protection laws. You acknowledge that any personally identifiable information you submit to or through the SNOWPASS Services and / or SNOWPASS Platforms may be used by us in accordance with our privacy policy. You agree to ensure that all personally identifiable information you provide to us is true and current and that you have obtained all necessary permissions, licenses, or approvals in order for us to use such information in accordance with these Terms and our Privacy Policy.

  1. If the SNOWPASS Services and / or SNOWPASS Platforms allow you to post, upload, transmit or otherwise make available any information, images, videos or other data with SNOWPASS or other SNOWPASS users (“User Content”), you are fully responsible for the User Content that you upload and represent and you agree not to share content for which you do not have the proper authorization or right of sharing and for which you cannot guarantee the license referred to in paragraph below;
  2. While all intellectual property rights in any User Content are held by you or your licensors, you represent that you grant SNOWPASS and our partners a non-exclusive, permanent, royalty-free, worldwide, transferable, and sublicensable license to use, reproduce electronically or otherwise, display, distribute, modify, adapt, publish, translate and create derivative works of any User Content (other than personally identifiable information), including for advertising and marketing purposes.
  3. SNOWPASS Services and / or SNOWPASS Platforms are not required to store, retain, publish or make available any User Content uploaded by you. If you provide us with suggestions, comments, improvements, ideas or other opinions (“Feedback”), you represent that we assign ownership of all intellectual property rights in that feedback and acknowledge that we may use and share that Feedback for any purpose at our discretion.

SNOWPASS Property

Unless otherwise defined in these Terms, all intellectual property rights which include, but are not limited to, copyright (including copyrights of computer software), patents, trademarks or trade names, design rights, of data, know-how, trade secrets and confidentiality rights on the SNOWPASS Services and / or the SNOWPASS Platforms (collectively, “Intellectual Property Rights”) are held by or licensed to SNOWPASS. By using the SNOWPASS Services and / or the SNOWPASS Platforms, you will not acquire any right, title or interest in connection with the SNOWPASS Services and / or SNOWPASS Platforms or Intellectual Property Rights, except for the limited license to use the SNOWPASS Services and SNOWPASS Platforms granted in accordance with these Terms. You further acknowledge that you have no right to access any aspect of SNOWPASS Services and / or SNOWPASS Platforms in the source code format.

Ownership of other people

We respect the intellectual property rights of others. If you believe that your copyright is being infringed by any content on the SNOWPASS Services and / or SNOWPASS Platforms, please send written notice of such infringement to info@snowpass.com

Warranty notice

Your use of the SNOWPASS Services and/or the SNOWPASS Platforms is at your own risk. To the extent permitted by law, we do not warrant that the SNOWPASS Services and / or SNOWPASS (a) Platforms are accurate, complete or current; (b) will always be available; (c) meet your expectations; or (d) are safe and free from errors, crashes, defects, viruses or malicious software.

Acquisition of SNOWPASS CARD with SNOWPASS

SNOWPASS is not a ski resort and the services that you use through the SNOWPASS CARD are provided by third parties (“Ski Resorts”). SNOWPASS CARD allows your access to partner ski resorts, but the terms and conditions applicable at the ski resorts (“Ski Resort Terms”) will define your rights to the ski resort and the responsibility of the ski resort before you in case of problems. You agree to fully comply with all Ski Resort Terms. You acknowledge that a breach of the Ski Resort Terms may result in cancellation of the SNOWPASS Card.

Limitations and exclusions of liability

These Terms define the full scope of SNOWPASS’s obligations and responsibilities with respect to SNOWPASS Services and Platforms.

SNOWPASS assumes no responsibility for any agreement you make with a third party as a result of your use of the SNOWPASS Services and / or SNOWPASS Platforms (including, without limitation, any Ski Resort). If the SNOWPASS Services and / or SNOWPASS Platforms contain links to other websites and features provided by third parties, those links are provided solely for your information. We have no control over the contents of these websites or resources and we assume no liability for damages or losses that may result from your use of them.

You may view advertising material sent by third parties on the SNOWPASS Services and / or the SNOWPASS Platforms. Each individual advertiser assumes full responsibility for the content of their advertising material and SNOWPASS assumes no responsibility for the content of the advertising material, including but not limited to any error, omission or inaccuracy therein. To the maximum extent permitted by law, we (together with our administrators, directors, employees, representatives, affiliates, suppliers and third parties) assume no responsibility for (a) any inaccuracies or omissions in the content displayed on or through the SNOWPASS Services and / or SNOWPASS Platforms; or (b) any natural disaster, accident, delay or any special, exemplary, punitive, indirect, incidental or consequential loss or damage (including, but not limited to loss of profits or savings), or based on contract, including negligence) or direct liability arising out of or in connection with your access to your use or inability to access or use the SNOWPASS Services and / or SNOWPASS Platforms or any content provided therein. Nothing in these Terms shall limit or exclude our liability which cannot be excluded by law.

Your responsibility to us

Under these Terms, you will be responsible to us for all actions, claims, procedures, costs, damages, losses and expenses (including, but not limited to, legal expenses) incurred by us or by our group and each of our administrators, officers, employees and agents arising out of or associated with your use of the SNOWPASS Services and / or the SNOWPASS Platforms or your breach of these Terms.

General provisions

You acknowledge that your unauthorized use of the SNOWPASS Services and / or the SNOWPASS Platforms may result in irreversible damage and loss to SNOWPASS and / or its affiliates or licensors, for which financial loss would be inadequate. As such, in the case of unauthorized use, we and our affiliates and / or licensors (as applicable) have the right, in addition to other legal remedies available, to bring an immediate injunctive action against you, prohibiting any use of the SNOWPASS Services and / or SNOWPASS Platforms. The nullity or non-observance of any of these provisions (in whole or in part) of these Terms shall not affect the validity and enforceability of all other provisions (in whole or in part). All or any part of any provision deemed invalid by a court of competent jurisdiction shall be deemed to be deleted from these Terms.

These Terms are for you personally. You do not have the right to assign these Terms, in whole or in part, to any third party without prior written consent.

These Terms represent all agreement between you and us and supersede all terms, conditions, agreements and arrangements regarding your use of the SNOWPASS Services and / or the SNOWPASS Platforms. We will act immediately if there is evidence of any User Content that breaches these Terms. If you become aware of or suspect any illegal acts or know or suspect that your work has been infringed, please notify us at the address given below, in the care of our “CLO”. Any failure on our part to enforce any of these Terms shall not constitute a waiver thereof or the right to enforce any of these Terms.

The following General Sales Conditions apply not only to the sale of SNOWPASS CARDS at www.snowpass.com web site, but also to third party web sites that redirect to it.

1.1 These General Terms and Conditions of Sale aim to regulate the relationship between SNOWPASS, LDA, a company with headquarters situated in Rua Quinta dos Medronheiros, nº 20, 2820-486 Charneca da Caparica, Portugal, a limited company incorporated and registered in Portugal, with the registration number 514818174, enrolled in the Almada Commercial Registry Office, and the User of the website www.snowpass.com

1.2 The website www.snowpass.com proposes products or services, which may be acquired by you in accordance with these Terms and General Conditions and other applicable elements contained in this site. Before proceeding with the acquisition of any product or service, the User agrees to be aware of the description and conditions of the offer, to which the same applies, defined and posted on www.snowpass.com

1.3 The Site User must be of legal age or duly authorized by its legal representatives. The elements and information transmitted by it shall produce full legal effects, while recognizing the validity and effectiveness of the electronic purchases and may not, under any circumstances, alleging the absence of signature as a ground for non-compliance with the obligations assumed or exemption from liability.

2. User Registration

2.1. To access vouchers for SNOWPASS CARDS promoted at SNOWPASS Web site, the User may proceed to their registration, through access to the site www.snowpass.com

2.2. The User registration data should be kept strictly confidentiality and the User should not, in particular, disclose them to third parties or navigate in conditions that allow their decoding and copy by third parties, and any access or use of the service with the data of your User area, are your exclusive responsibility.

2.3. The personal information or data entered in each of the fields of the Form, must be accurate and the User is obliged to keep up to date with the information in his User area.

2.4. SNOWPASS does not assume any responsibility for the inaccuracy of the information provided by the User, which responds to the accuracy and precision of the information provided and personal data entered.

2.5. The registered User undertakes to inform SNOWPASS immediately, from any unauthorized use of his User area, as well as unauthorized access to his account, through an email message sent to info@snowpass.com.

3. Acceptance of the General Terms and Conditions of Use

3.1. In the context of the purchase process, the User must accept the terms and conditions of use available on the site www.snowpass.com, by confirming on the respective key.

3.2. Without prejudice to and regardless of what is mentioned on the number above, the User acknowledges that at each time he uses the website www.snowpass.com, he is agreeing to the Terms and Conditions of current use.

3.3. The General Terms and Conditions of use may be accessed, printed or stored locally at any time and on any durable media.

3.4. By accepting the General Terms and Conditions of Use, the User authorizes SNOWPASS to send promotional messages through different communication channels, of informative nature, referring to promotions made available or to be made available on the website www.snowpass.com. If the User wishes to exercise the right to objection to the sending of such messages, he must do so on the website www.snowpass.com, through the means available to the effect.

4. SNOWPASS CARD – Product Description

4.1. The SNOWPASS CARD is a multi-country ski pass, valid for the ski season of 2019/2020 for the underwritten period and its acceptance at partner ski resorts or ski areas is guaranteed pursuant to written Contracts between SNOWPASS and each ski resort or ski area.

4.2. For the ski season of 2019/2020, it can be used from 01.11.2019 to 25.04.2020, submitted to each individual opening dates, at the partner ski resorts.

4.3. The SNOWPASS CARD is a personal and non-transferable card, issued with the name, surname, photo and date of birth of its holder, that can be exchanged at each partner ski resort for the corresponding ski pass for the wanted ski days (with a limit of up to 10 days at each ski resort or ski area).

4.4. In addition to the partner ski resorts, some companies which have Agreements with SNOWPASS may offer other benefits to the holders of a SNOWPASS CARD.

5. SNOWPASS CARD – Age Categories

5.1. For effects of selecting an adequate SNOWPASS CARD, the birth date must be considered:

    Baby: born between 2016-2019 (inclusive)

    Child: born between 2007-2015 (inclusive)

    Adult: born before 2006 (inclusive)

6. SNOWPASS CARD - Period of Sale

6.1. For the ski season of 2019/2020, SNOWPASS CARDS will be available for purchase between 12/05/2019 and 31/12/2019.

7. SNOWPASS CARD – Sales Channel

7.1. SNOWPASS CARDS can be sold through several channels:

a) Online through the digital platform of SNOWPASS at www.snowpass.com

b) Online through the digital platform of partner ski resorts;

c) Online through the digital platform of other partners;

d) Physically, at the points of sales of other partners, shops and ski resorts, through the sale of vouchers;

e) Any entity if previously authorized by SNOWPASS;

8. Acquisition of the SNOWPASS CARD

8.1. To proceed with the purchase of SNOWPASS CARD on the website of SNOWPASS, the User must observe the following procedures:

  • - Select the products;
  • - Finish the purchase with the respective payment;
  • - Confirm acceptance of the General Terms and Conditions of use of www.snowpass.com;

8.2. Vouchers corresponding to the SNOWPASS CARDS purchased will be made available to the User upon verification of compliance of all established requirements or assumptions.

8.3. The voucher corresponding to the SNOWPASS CARD purchased will be sent to the email address associated with the User account.

8.4. Upon receipt of the voucher, within 30 days, SNOWPASS will send an email with a link where the User should access and fill in the data required and upload a photo in order to receive a digital SNOWPASS CARD.

8.5. Before the ski season of 2019/2020, the User will receive a physical SNOWPASS CARD, at the address provided by the User, that grants the use of the partner ski resorts or ski areas.

8.6. During the ski season of 2019/2020, the User should contact the corresponding service provider (ski resort), at the arrival and pick up the ski pass with them, unless otherwise referred on the website www.snowpass.com or in the conditions described on the website of the respective ski resort.

9. SNOWPASS CARD - Voucher conditions

9.1. All vouchers sent to the email address of the User incorporate security codes that guarantee their uniqueness.

9.2. The reproduction, editing or manipulation of the vouchers is not allowed. In the event of a reasoned suspicion of any of these actions, SNOWPASS reserves the right to take all measures it deems appropriate, and in particular with the respective Partner ski resort and the competent authorities.

10. SNOWPASS CARD - Card conditions

10.1. The Service corresponding to the SNOWPASS CARD can only be used at the partner ski resorts or ski areas. In addition to the partner ski resorts, some companies which have Agreements with SNOWPASS may offer other benefits to the holders of a SNOWPASS CARD.

10.2. The SNOWPASS CARD entitles the User the right to use the services of each partner ski resort / ski area to which it relates, on the dates specified for that purpose.

10.3. The SNOWPASS CARD is valid for the entire period from 01/11/2019 to 25/04/2020, subject to the opening and closing dates of partner ski resorts.

10.4. SNOWPASS CARD must be exchanged at each partner ski resort, with no extra costs, for the corresponding ski pass for the wanted number of ski days. However, the general conditions of ski resorts, regarding the physical support of ski passes, may be applied.

10.5. The User understands and gives his permission so that, in order for SNOWPASS to provide a better service, some of his personal data must be provided to the partner ski resorts / ski areas as well as to other SNOWPASS partners.

10.6. Each partner ski resort may verify the SNOWPASS CARD, at any time during its use, in order to ensure that it is before the person to whom it is entitled and may request the presentation of an identification document in that process.

10.7. The SNOWPASS CARD has a limit of 10 days use (consecutive or interpolated) at each partner ski resort or ski area, with no date restrictions.

10.8. The ski resorts that are part of the groups / areas listed below share the 10-day limit within the group / ski area. The SNOWPASS CARD holder has the right to ski up to 10 days within the group of ski resorts / ski area, choosing how to allocate the 10-day limit between the ski resorts of that group / ski area:

  • -     FVG (Kanin, Zoncolan, Piancavallo, Ravascletto, Forni di Sopra, Tarvisio, Sauris, Sella Nevea)
  • -     PSB (Champex Lac, La Fouly)
  • -     Rousses (Massif des Tuffes, Massif de la Serra, Noirmont, La Dôle)
  • -     Mercantour (Auron, Isola 2.000)

10.9. In addition to the partner ski resorts, some extra ski resorts may accept the SNOWPASS Card, in which case their use will be subject to a lower day limit. These extra ski resorts must be listed on the web site of SNOWPASS to be considered partners.

10.10. The SNOWPASS CARD does not include rescue insurance. In the case that the User wants to add such insurance, he should inform the ski resort and pay the corresponding extra costs for the service.

10.11. In the event of non-use of the SNOWPASS CARD, its holder will not be entitled to any refund, even if non-use is due to force majeure, such as illness or accident.

10.12. SNOWPASS reserves the right to return the money related to the purchase of the SNOWPASS CARD and to cancel the agreement, at any time and at its discretion, without the User being entitled to any other compensation.

10.13. In the event of loss or theft of the SNOWPASS CARD, its holder shall immediately inform SNOWPASS, providing the number of the lost card and request its immediate cancellation and issuance of a new card.

10.14. In the event of loss or theft of the SNOWPASS CARD, the issuing and sending of a new SNOWPASS CARD have an associated cost of 50 EUROS (or equivalent in local currency) that will be charged on account of its replacement, due to administrative fees and shipment costs.

10.15. Each SNOWPASS CARD is personal and non-transferable. It may not be transferred, even free of charge, nor may it be altered. Its holder understands and accepts that any misuse, as well as use of a third party, will be punished and will result in withdrawal of the card, causing its immediate cancellation.

10.16. Any attempt to use the SNOWPASS CARD that is not in accordance with these General Terms and Sales Conditions, will be considered fraudulent use. In case of detection of fraudulent use, a cost of 895.00 EUROS (or equivalent in local currency) will be charged to any abusive user. In addition, transgressors may be subject to civil and criminal liability.

11. SNOWPASS CARD – Partner ski resorts / ski areas

11.1 The list of partner ski resorts / ski areas is available from 8th May 2019 on the web site www.snowpass.com

11.2. The list of partner ski resorts / ski areas may be updated at any time, and more ski resorts / ski areas may join the group of SNOWPASS CARD partner ski resorts.

11.3. The use of partner ski resorts and all their operating and open lift system facilities is given to SNOWPASS CARD holders, pursuant to written contractual commitments previously settled with SNOWPASS.

11.4. SNOWPASS CARD holders understand and accept that such access is subject to the opening and closing dates of the ski resorts during the ski season, and that there is no way for SNOWPASS or the partner ski resorts to ensure the full operation and uninterrupted function of all their ski slopes during the entire ski season.

11.5. Ski resort owners and operators are the only responsible ones for the management and operation of the respective lift system facilities and their connected services.

11.6. In the event of non-opening, or forced interrupt of functioning, of a partner ski resort, totally or partially, due to force majeure, namely, but not limited, to adverse weather conditions, natural disasters, acts of terrorism and vandalism, lift technical failures, energy blackouts, secure and safety reasons, the holder of SNOWPASS CARD will not be entitled to apply for any reimbursement.

12. SNOWPASS CARD - Prices

12.1. Prices indicated on the website www.snowpass.com may be consulted in the various currencies that are available on the website.

12.2. According to the age category, the prices of the SNOWPASS Cards are the following:

12.3. All prices listed above are quoted in Euros, or equivalent in local currency, with VAT included.

13. SNOWPASS CARD - Payment Terms

13.1. Only electronic payment system (Pay Pal and Debit/Credit Card) will be accepted for the online sales of SNOWPASS CARD.

13.2. The Voucher will only be issued upon receipt of payment, and then sent to the respective email account associated with the User.

13.3. To make the payment, the User shall provide information about his credit card, namely the expiry date and the three (3) security digits.

13.4. It is the responsibility of the User to promote the bank operations and any eventual authorizations that enable him to make an online purchase.

13.5. In the event that a value is improperly charged, the User shall immediately inform SNOWPASS, sending an email message to info@snowpass.com, in order to solve the situation as soon as possible.

14. Guarantees and responsibilities

14.1. SNOWPASS does not supply the services entitled by the SNOWPASS CARD nor does it account for their quality and quantity

14.2. SNOWPASS guarantees that the SNOWPASS CARD assigns the right to the use of the skiing facilities of the partner ski resorts from 01/11/2019 to 25/04/2020, subject to the opening and closing dates of partner ski resorts.

14.3. SNOWPASS does not assume any guarantee or responsibility, nor does it respond to infringement of the obligations by the Ski resorts / Partner within the established relationship.

14.4. SNOWPASS is not responsible for misuse that the User makes of the applications or the contents of the website www.snowpass.com, falling him solely and exclusively on the Responsibility for such misuse.

14.5. The partner ski resort shall be solely responsible for providing the use of the skiing facilities to the holder of a SNOWPASS CARD

14.6. SNOWPASS will not be responsible for SNOWPASS CARDS acquired and / or used improperly.

14.7. If difficulties arise to get the ski passes corresponding to the SNOWPASS CARD with the partner ski resort, the user must contact SNOWPASS by sending an email message to info@snowpass.com, or by any other means otherwise available on the www.snowpass.com platform. SNOWPASS, thereby compromises to do everything within its power to solve any difficulties in the shortest time possible.

15. Resolution

15.1. The User, in case of acquiring the SNOWPASS CARD online, can exercise the right of withdrawal without any compensation being required to him, for 10 working days, after the purchase, provided that the SNOWPASS CARD has not yet been used.

16. Effects of resolution

16.1. In case of termination of the contract by the User in the terms of item 15.1, he will be refunded of the amount paid within the maximum of 10 working days from the resolution, in the same modality on which the payment was made.

16.2. It is an imperative condition for the right of reimbursement the non-use, even partially, of the SNOWPASS CARD by the User.

17. Intellectual and Industrial Property

17.1. The User acknowledges that www.snowpass.com is property of SNOWPASS and contains information protected by copyright and related rights, industrial property and others emerging from other applicable legislation.

17.2. The User acknowledges that any content in the site, namely advertising, promotion or mention of any sponsor, advertiser or Partner, is protected by the laws on copyright and related rights, industrial property and other property protection laws, so any use of such content may only occur under express authorization of the respective owners of the rights conferred by the by this legislation.

17.3. If the User detects any act that may constitute infringement of intellectual, industrial or any other type of right, shall inform SNOWPASS by an email message to info@snowpass.com.

18. Privacy and Personal Information

18.1. Personal data, identified as of mandatory supply, are indispensable to access and use of the website www.snowpass.com and are automatically processed for this purpose, being its treatment the responsibility of SNOWPASS.

18.2. In legal terms, the User is guaranteed the right of access, rectification and updating of his personal data, as well as the right to use them, directly on the www.SNOWPASS.com in the reserved area section.

18.3. The User acknowledges and accepts that, when the Internet is being used, access to and use of the www.snowpass.com website and the collection of personal data, there is the risk of his personal data being viewed and used by not authorized third parties, and SNOWPASS cannot be liability responsible, in particular, from improper access, elimination, destruction, modification and loss.

18.4. The omission or inaccuracy of personal data or of other information provided by the User, are of his entirety responsibility.

19. Sharing your information with FIS (International Ski Federation)

19.1. FIS (International Ski Federation) integrates the network of SNOWPASS partners in the area of the partnership of the product SNOWPASS CARD, which promotes the development of the leisure practice of winter sports.

19.2. By using the SNOWPASS services you expressly acknowledge and agree that SNOWPASS shares your personal data with FIS, for processing outside SNOWPASS’s control and for their own purposes namely, but not limited to, sending promotional information and for direct marketing purposes.

19.3. You also understand and accept that some of the personal data shared with FIS may enable that you are identified as an individual in the offline world, such as first name, last name, email, date of birth, address and country.

19.4. Your personal data will be disclosed in accordance with the terms described in Recital 47 of the General Data Protection Regulation (EU) 2016/679 ("GDPR").

20. Functionality and availability of the website www.SNOWPASS.com

20.1. SNOWPASS reserves the right to alter, limit or cancel, at any time, the functionalities of the site www.snowpass.com as long as they are not required for complete purchases of vouchers already in progress, as well as cease the use and access to it.

20.2. Although SNOWPASS develops its best efforts to ensure access to and use of the site www.snowpass.com on a regular and continuous basis, these can be limited or temporarily interrupted, in particular when it is necessary to guarantee maintenance or updating work of the support platform.

20.3. The interruption or termination, by SNOWPASS of access and use of the site www.snowpass.com, under the terms of the numbers above, do not give the User or third parties the right to any indemnification and SNOWPASS cannot be held responsible by any consequence thereof.

20.4. Although all control mechanisms are properly implemented, site errors may occur on www.snowpass.com, in particular because it contains links to other sites and make available the contents offered in them, therefore SNOWPASS must not be held liable for any damages or loss thereof.

20.5. The website www.snowpass.com has the appropriate security levels, therefore SNOWPASS is not liable for any damages suffered by the User and / or third parties, due to delays, interruptions, errors or suspensions of communication, to access and use of the site, motivated by external facts out of its control, in particular deficiencies or malfunctions in the network and / or electronic communication services provided by third parties.

20.6. These General Terms and Conditions of Sale may be updated by SNOWPASS without prior notification to Users, whenever deemed necessary or desirable, due to legal requirements or operation changes.

21. Partial Invalidity

21.1. If any provision of these General Terms and Conditions are considered null and void, for any reason, the validity of the other provisions shall not be affected, unless the User or SNOWPASS demonstrates that the purchase would not have been completed without the flawed party.

22. Applicable law / Forum

22.1. These General Terms and Conditions of Sale are firstly subject to the Online Dispute Resolution (ORL), in the accordance with Directive 2013/11 / EU of 21 May 2013 on the alternative dispute resolution and Regulation 524/2013 of 21 May 2013.

22.2. In case of failure to resolve any dispute in the accordance manner, as written in 21.1. the Judicial Court of Lisbon shall prevail, expressly waiving any other, and the Portuguese Law will be applied.

22.3. The mandatory provisions of the country in which the user resides shall remain unaffected by this legal decision.

23. Language Clause (English)

23.1. The whole text of this document, as well as the documents derived from it, was originally written in English and then translated to other languages. All the other versions in any other language shall be only for support and help in understanding.

23.2. SNOWPASS strongly recommends the reading of the official English version and should not be deemed responsible for any translation or interpretation errors that may exist in other languages. In case of any doubt or discrepancy of interpretation, the English version of the document shall prevail. For legal purposes the text in English is the binding one.
